End-User License Agreement for 'Tool&Task' (Software Product)

 

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Homer Software und Design GmbH (Homer). If you do not agree to any terms of this EULA, do not use 'Tool&Task'.

 

Software Product License

 

The Software Product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software Product is licensed, not sold. This EULA grants you the following non-exclusive rights: You may use the Software Product on as many computers as you want and can subscribe to the Tool&Task 'Update&Info Service'. The use of Tool&Task as well as the common 'Update&Info Service' is free of charge. Services beyond, you might request and Homer might offer, are not part of this Agreement.

 

Registration

 

Homer Software und Design GmbH does not require a registration for the use of 'Tool&Task'. If you want to join the Homer 'Update&Info Service' for this program, you should provide your correct e-mail address to enable us to contact you in case of any inquiry. Homer will keep your email only for the direct contact to you and not disclose it without your consent.

In the case you had subscribed to the 'Update&Info Service', your e-mail address is erased from the database when you unsubscribe. The information is not deleted from database-backups and might be restored unintentionally. If an unsubscribed registration is still valid on other computers, it will be voided at the next contact with the Homer server.

 

Disclaimer of Warranty.

 

There is no warranty for the program, to the extent permitted by applicable law. Except when otherwise stated in writing the copyright holders and/or other parties provide the program 'as is' without warranty of any kind, either expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the program is with you. Should the program prove defective, you assume the cost of all necessary servicing, repair or correction.

 

Limitation of Liability.

 

In no event unless required by applicable law or agreed to in writing will any copyright holder, or any other party who modifies and/or conveys the program be liable for your damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the program (including but not limited to loss of data or data being rendered inaccurate or losses sustained by you or third parties or a failure of the program to operate with any other programs), even if such holder or other party has been advised of the possibility of such damages. In no event, the liability of Homer may exceed the money you paid for the Software Product.
